Wicked Bachelor Terms and Conditions

1. DEFINITIONS AND INTERPRETATIONS


"Arrangements" means any accommodation, meals, services, facilities or other arrangements (or any of them), as applicable, booked through us in accordance with this agreement or any other agreement between you and us.

"In writing" means by facsimile, email or letter.

"Organizer" means the individual who makes the booking on behalf of the group, company or other entity named in the booking confirmation (and any substitute for this person).

"We" "us" and "our" are references to Wicked Bachelor Ltd.

"You" "your" or the "party" are reference to the group, company or entity named in the booking confirmation.



2. ENTIRE AGREEMENT


These terms and conditions of booking set out our obligations to you and your obligations to us when you book any Arrangements.

The information contained in your booking and these terms and conditions constitute the entire agreement between you and us.

The agreement between you and us only comes into existence once your booking has been acknowledged in writing by us. Bookings made via telephone or email are subject to the terms and conditions set out herein.

It is important that you read through these terms and conditions before you book. These terms and conditions apply to all bookings with us whether you have chosen to read them or not and are applicable to all members of your group.



3. ORGANIZER'S RESPONSIBILITIES


The Organizer will be our point of contact with you. We will send all documents relating to the Arrangements including any tickets or vouchers to the Organizer.

The Organizer must check all such documents and must contact us immediately if any information appearing in the booking confirmation or any other document appears to be inaccurate or incomplete.

The Organizer is responsible for each reservation and for ensuring that everyone within the group is aware of these terms and conditions.

The Organizer is individually liable to pay to us all amounts arising under this agreement when due.

If for any reason there is a change in the Organizer you must notify us immediately in writing.

Unless notified to the contrary, we will assume that the Organizer has the authority to deal with us on your behalf.



4. DEPOSIT


To book any Arrangement you must pay a non-refundable deposit of $200.00, or such other amount as may be specified by your event consultant, at the time of booking (the "Deposit").

By paying the Deposit the Organizer confirms the accuracy of all the information provided to the event consultant and accepts these terms and conditions on behalf of the group.

We will not confirm the Arrangements until we have received the Deposit. The Deposit is non-refundable and non-transferable, however we will use reasonable efforts to accommodate transfer requests.



5. FURTHER PAYMENTS


You must pay the outstanding balance for the Arrangements on the date that is 3 weeks prior to the commencement date of the Arrangements except as otherwise specified in writing by us (the "Final Payment Date"). You may pay the outstanding balance any stage prior to the Final Payment Date.

Any booking made within 3 weeks of the commencement date of the Arrangements will require full payment at the time of booking except as otherwise agreed in writing by us.

No documents relating to the Arrangements, including any tickets or vouchers, will be delivered until the booking has been fully paid. Your booking may be cancelled if full payment is not received by the Final Payment Date. If your booking is cancelled we will retain the Deposit and reimburse any other payments already received from you.

Some third party suppliers have established minimum group sizes for certain events and activities. The cost to you of the Arrangements may be adjusted if your group falls below such minimum group size resulting in extra charges.



6. CHANGES BY YOU


All changes must be requested in writing by the Organizer.

We will make reasonable efforts to accommodate your changes but may not always be able to do so.

If you make any changes directly with the supplier you agree to pay any additional costs to us which result from that change.

We will assume that after the final payment has been made the group size is confirmed. Adding additional group members after the Final Payment Date may incur additional charges. The addition of group members is subject to availability.

To change a departure date, activity or destination, you will incur an additional $25 charge and the proposed change will be subject to availability.



7. CHANGES BY US


If we have to make a significant change to your Arrangements at any time we will inform you as soon as possible. We reserve the right to (at any time) cancel or change any Arrangements made and to substitute alternative Arrangements without accepting liability. Should alternative Arrangements be made at a reduced cost, the difference will be refunded to you. Should the alternative Arrangements be made at an increased cost, the increase in cost must be met by you.

We reserve the right to cancel any itinerary and tour (before commencement of the arrangements) due to force majeure, health concerns or any other reason outside our control that we, in our absolute discretion, may determine. Force majeure events include (but are not limited to) war or threat of war, riot, civil strife or unrest, Act of God, strikes, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, technical or maintenance problems with transport, changes imposed by rescheduling or cancellation of flight or transport by airline or road traffic conditions, or any other event that is beyond the reasonable control of us.



8. CANCELLATION


Cancellation of booking can only be accepted if made in writing by the Organizer and will only be considered cancelled when written notice is received. Upon cancellation, we will refund all moneys paid in respect of your booking prior to the cancellation other than the Deposit and any monies which have been paid to Suppliers.

We will not provide any refund in respect of a member of your group who fails to attend on the date of the Arrangements or is required to depart early from the Arrangements.



9. THE WEATHER


You may be unable to take part in weather dependant activities due to poor weather conditions. If this occurs, you will be entitled to change or cancel Arrangements without paying normal charges or being subject to the cancellation policy. We will assist you to find alternative activities or Arrangements but please bear in mind that these may only be available at an additional charge to you.



10. LIABILITY


We do not provide the services associated with the Arrangements you book through us. Third Party suppliers will provide those services. They are obligated to ensure that you are safe and to adhere to all applicable laws or regulations. They will also have adequate insurance. Some Arrangements could include elements of risk. We take no responsibility for any loss, damage or injury incurred by any of you taking part in such Arrangements.



11. PRICE


The prices for the Arrangement(s) are detailed in your booking confirmation. Prices shown are correct at the time of going to press and we make all reasonable efforts to ensure they are accurate. Please note that the price may change as a result of suppliers of services or other relevant matters pertinent to your Arrangements which may be out of our control. We will advise you in writing of any increase in fees payable which must be paid in full prior to the Arrangement commencement date. We reserve the right to change any of the event/facilities or prices described on the website before the Arrangements between you and us are concluded. Booking more than one activity may result in a discount price being offered by us for the Arrangements. These discounts may only apply when paying for the whole package. If you decide to partake in only certain aspects of the Arrangements you may not be able to take advantage of these discounts. All prices are inclusive of GST. Prior to booking, prices given on quotes, website packages, event consultant emails and those made verbally are subject to availability and subject to change at any time. We make every attempt to ensure that all prices given are accurate at the time of enquiry. You will be given the current price of your Arrangements at the time you wish to book and before your contract is confirmed. Where a price is incorrect due to system error, we shall not be bound by such price. When a group is staying at a hotel and they have an odd number on any given night, we will, where possible try and place them in a triple room. If this is not possible, a single supplement may be charged to you to cover any sole occupancy charge levied by the hotel. The single supplement charge will be specified by your hotel.



12. BEHAVIOUR


You are required to respect your environment, the other people around you and the personnel and property of the third party suppliers providing the Arrangements. Any such supplier, facility or hotel may, without notice, ask an individual member of your Group to depart early from the Arrangements or terminate your stay or activity for any reason, including, without limitation, physical, emotional or verbal harassment, vandalism or any other behaviour that they deem to be inappropriate by them. In such cases, you will not have any entitlement for a refund of any kind whatsoever.

We accept no liability for any accident or misadventure that occurs while any of your group is under the influence of drinks or drugs. Please also be aware that some hotels may require a damage deposit to be placed on hold with a credit card or cash, upon check in. We will do our utmost to give you prior notice where this might happen, but in some extreme cases this may not be possible. Please check with us when paying your final balance.



13. THIRD PARTY SUPPLIERS


We rely on independent third party service providers to provide you the services connected with the Arrangements. We use our best endeavors to source premium entertainment from providers who are independent contractors. However, we are not responsible or liable to you or members of your group for the actions or inactions of such third party independent contractors who agree to provide the services connected with the Arrangements.



14. AGE RESTRICTIONS AND LIMITS


Unless you advise us to the contrary we will assume that every member of your group is over 19 years of age. If this is not the case and some members of your party do not fall into this age category, please check with us that the events you book can accommodate the younger members of your party. We accept no responsibility for the inability of any member of your party to participate in the Arrangements if you fail to check with us whether or not the activities or events you wish to book through us are subject to any age restrictions prior to booking. Some of our activities or events may not be participated in due to height / weight / pregnancy / disability / medical / health restrictions. It is your responsibility to ask us if there are any of the aforementioned restrictions regarding any events you may have booked with us. Failure to do so may result in group members not being able to participate in certain events. We will not be liable to provide a refund to you or any member of your group in such circumstances.



15. ITINERARIES


Our itineraries are designed for you to achieve maximum enjoyment from your Arrangements. The times provided must be adhered to at all times and failure to do so may result in your group being unable to participate in the Arrangements. We will not be held responsible should you fail to follow our advice or adhere to our planned timings. Please note on occasions certain activities such as some dance classes and boat cruises will not confirm the venue till around 1 week prior to the Arrangements taking place. As a result your itinerary may be sent without the location and will be amended nearer to the date of the Arrangements taking place.



16. COMPLAINTS


If you have a complaint regarding any aspect of the Arrangements, you must communicate your complaint to the third party supplier of the service concerned at the earliest opportunity and also contact us to let us know of your complaint. If you do not inform the supplier of the service as well as us within 48 hours of the reason for the complaint occurring, we will not be responsible for the complaint in any way whatsoever. If the complaint has not been dealt with to your satisfaction before your return home, then you must make a complaint to us in writing no less than 7 days after your return from the event or activity. You will receive a reply within 28 days after we receive your complaint in writing. If you do not comply with the complaints procedure, we will not be responsible or obligated to consider the merits of your complaint.
